Welcome to the Monad Trust Trading As the Monad Centre of Balance Pty Ltd ("Monad Centre") Website. The Monad Centre provides services and products to you subject to the following terms, conditions, notices and disclaimers as amended from time to time at our discretion. The date of amendment and updates will be noted at the end of this document.
By accessing, browsing or utilising any or all of the services and products within or provided by the Monad Centre, you acknowledge that you understand and agree to the Terms and Conditions contained herein. If you do not agree with the stated Terms and Conditions, the Monad Centre advises that you do not use the service.
The Monad Centre reserves the right to amend, change or omit this site at our discretion. Additionally we reserve the right to institute changes or amendments (effective immediately) to any or all of the Terms and Conditions contained in this document and to which, by your utilisation of the Website, you are bound.
The Monad Centre reserves all Copyright of Website content pertaining to all information, documents, graphics materials, photographs, images or videos. The use of any content herein stated must be approved by the Monad Centre through a written request from you, and a response from the Monad Centre in writing.
Pricing of products and services on our Website are competitive and current. We reserve the right to alter these prices accordingly to align with price inflation in order to maintain competitiveness in the market and to continue to provide quality services and products.
The Monad Centre reserves the right to terminate access, refuse service, terminate accounts, and/or cancel orders at its discretion and at any time without notice.
Unauthorised use of a credit card, use of an invalid card and/or the provision of a false name and personal details will be considered fraudulent. All fraudulent activity will be subject to prosecution by the fullest extent of the law.
The Monad Centre will endeavour to fulfil its commitment to the stated delivery schedule of purchased items but cannot guarantee to meet scheduled delivery times on all occasions. Delivery times are an approximation that does not take into consideration unforeseen delays experienced by Australia Post or any carrier we contract to deliver goods.
PURCHASE OF SHIPPING ITEMS- AUSTRALIA WIDE ONLY
An order placed by you is an offer to purchase a particular product at the price and delivery charges specified on this Website. Please note we do not take back orders. We reserve the right to accept or reject your offer for any reason. Prices and products and delivery charges, and product and service availability are current at the time of issue but are subject to change at any time without notification. To efficiently process your order you must submit your name, email address, mailing address, credit card number and the expiry date of your credit card. You must provide accurate personal details and information. Your contract with the Monad Centre is operable when we advise that your order has been accepted and receipt of your payment is confirmed.
- All items will be shipped within 2-4 working days once full payment has been received and cleared. If items are not available we will contact you to make alternative arrangements.
- Shipping rates are calculated by size, weight and destination of order within Australia and ship by Australia Post or other carriers as required.
- All items purchased are defaulted to Express Post. Please allow -2-3 working days for your item to be delivered within Australia. This will protect your purchase and allow you to track its journey to you and provide a receipt to us that goods have been signed for at your end.
- It is important that you double check your postal address before you complete your payment. We do not refund or replace products shipped to incorrect postal address entered by you on our Website or confirmed by email.
Exchange of Goods
In the event that you received an incorrect item that we have sent in error please contact us within 14 working days and we will respond with an email of approval of return. Please return it in the box it was sent in including the details of your chosen item and we will make that exchange. Proof of purchase should accompany the posted item. If the amount of the exchange varies from the original product you will be required to pay the difference.
Please choose your items carefully as we do not refund or replace products for incorrect orders being placed by you.
Damaged or Faulty Goods
If you receive a product which has been damaged during delivery or is faulty please call or email us. Damaged or faulty goods will be promptly replaced, exchanged or a full refund issued.
This Policy does not apply to goods which have been worn, used or damaged after delivery or any attempt has been made to alter the product or if they have been dropped or broken, these are not refundable.
PURCHASE OF THERAPY SERVICES, WORKSHOPS, EVENTS, MEDITATION CLASSES:
After placing your order online you will receive an email confirmation your purchase from eWAY. Confirmation of receipt of your order normally occurs within a few minutes from when you place your order. If you have booked into an event we will contact you closer to the date to confirm your booking and general details to prepare you to enjoy your event. If you have paid in advance for a therapy service online we will contact you to schedule a date and time that suits you to enjoy your therapy. If you have booked for a meditation class we will send you a confirmation email or text acknowledging your attendance to a class. Please note the policy relating to these bookings below:
- Cancellation and Refund for Events:
If you are unable to attend an event we require 2 weeks notice in writing. 50% refund is provided back to you once we receive your email or letter in the period advised here. We have a NO REFUND OR TRANSFERABLE POLICY outside of this ruling.
- Cancellation of therapy appointments:
Changes to therapy appointment times and dates as well as cancellations must be made within 24 hours of your appointment. Changes and cancellations to therapies made after this time will incur a 20% fee to cover administration and lost of revenue due to late cancellation. You will receive a reminder text message or email 2 days before your appointment.
- Cancellation of meditation classes:
Please note that when you register into a meditation class run by Iva and Neil of the Monad Centre we confirm back to you your booking for that class. You have 1 transferable option allowing you to change your booking to another date and time, if you are not able to make it the booking becomes non-transferable or refundable. No bookings can be transferred to another person. We have a no refund policy to a booking if you are not able to attend.
PURCHASE OF GIFT VOUCHERS
Our gift vouchers have a six months expiry date. This is noted on the Gift Voucher you purchase and in the Online Shop where you can also purchase a Gift Voucher. It is up to you to call the Centre and book in and use your voucher before the expiry date. Outside the six months, THERE ARE NO EXTENSION OF DATE AND TIME FOR GIFT VOUCHERS. Our Vouchers are express post to the purchaser they are not electronically sent unless requested and it is sent to the email provided by the purchaser . If you want the voucher to be sent to another address or email you will need to provide all these details when purchasing including your contact details as we sometimes contact people to double check information if they are not clear.
Limitation of Liability
The Monad Centre will in no circumstances, to the extent permitted by law, be liable for any damages or loss whatsoever, whether direct, indirect, punitive, special, or consequential.
Where the Monad Centre is unable to exclude liability for breach of Terms and Conditions of any implied warranty by virtue of any statute, then its liability shall be limited to any one or more of the following:
If the breach relates to products where error is on our part:
- The replacement of the goods or the supply of equivalent goods.
- The repair of the goods.
- Payment of general postage of repaired or replaced goods to the client.
If the breach relates to services:
- We will endeavour to rectify your concerns with you with the objective of coming to some agreement that you are satisfy with.
The information contained within this Website is provided by the Monad Centre in good faith that the information is accurate and current and is represented in accordance with Australian law. The Monad Centre makes no representations or warranties of any kind, expressed or implied, as to the operation of the Website or the information, content and materials, including the currency, accuracy or completeness, of any content or any information provided by third parties, on or through the Website. The Monad Centre disclaims the accuracy of all descriptions and specifications of the products included on this Website.
The Monad Centre will not be liable for any damages of any kind arising from the use of this Website, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
The Monad Centre will not guarantee that your access to the Website or the functions contained within will be uninterrupted or error free. The Monad Centre will not guarantee that any errors will be corrected or that the Website or the server is free of viruses, malicious computer code transmitted on or through the Website or other harmful components.
